A Legal Obligation

Brighton & Hove City Council is the data controller for purposes of the EU General Data Protection Regulation and any UK laws supplementary to this and is registered as a data controller with the Information Commissioner’s Office (ICO) under registration number Z5840053.

Healthwatch Brighton and Hove have been commissioned by Brighton and Hove City Council to carry out an engagement activity in relation to the Community Equipment Service. For the purposes of this activity Healthwatch Brighton and Hove are a data processor. Healthwatch Brighton and Hove are also a data controller in their own right and are registered as a data controller with the ICO under registration number ZA100641.

Brighton & Hove City Council and Healthwatch Brighton and Hove are committed to protecting your personal information. As a data controller Brighton and Hove City Council have a responsibility to make sure you know why and how your personal information is being collected in accordance with relevant data protection law.

Why we are processing your data

  • We are collecting and processing your data for the purpose of obtaining views of people living in the city who have received/or may need in the future to receive some equipment or minor adaptation to their home.
  • The Council provides care services as regulated by the Care Act 2014 and this survey is being undertaken under legal obligation (GDPR Article 6, 2 e), with a view to informing the provision of better services which in this case includes the procurement and provision of a Community Equipment Service. We have an obligation to undertake continuous improvement of our functions under the Local Government Act 1999 Section 3.
  • We are collecting and processing your special category data for reasons of substantial public interest (GDPR Article 9, 2 g) and the Data Protection Act 2018 Schedule 1, Part 2, Para 8 and Schedule 1, Part 1, Para 2 (e). 

We will hold your raw data until 31st January 2022, but if you say on the form that you are being hurt or harmed by anybody or you are extremely worried about your personal safety, we may refer some of your data to other Council Teams in order to safeguard your wellbeing. This would be done under the lawful basis of legal obligation. In these cases, the data may be retained by these services for longer, depending on the nature of services the Council needs to provide.
